This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when individuals visit our websites, use our software and services, communicate with us, interact with EQAI-powered AI Partners, complete assessments, submit forms, or otherwise engage with EQAI.
This Privacy Policy also explains certain choices and rights that may be available regarding personal information.

This Privacy Policy applies to personal information EQAI collects directly in connection with:

The EQAI Customer Intelligence Platform;
AI Partner experiences;
Assessments and personalized reports;
Customer onboarding;
Account registration;
Support;
Billing;
Sales and marketing communications;
Analytics;
Campaign attribution;
Booking and routing workflows; and
Other EQAI services.
EQAI also processes information on behalf of business customers that use the EQAI platform on their own websites or customer journeys.
In those situations, the applicable EQAI customer generally determines the purposes for which the information is collected and processed. That customer’s privacy policy may also apply.
If you are interacting with an EQAI-powered AI Partner on a third-party business website, questions about that business’s use of your personal information should generally be directed to that business.
2. Information We Collect
The information we collect depends on how you interact with EQAI and how a customer configures the Services.
We may collect the following categories of information.
Account and Business Information
This may include:
Name;
Business name;
Job title or role;
Email address;
Telephone number;
Business address;
Website;
Industry;
Account credentials;
Subscription information;
Account preferences; and
Other information provided during registration or onboarding.
Customer and Prospect Information
When EQAI is used to engage website visitors, prospects, customers, guests, members, or users, the platform may collect information such as:
Name;
Email address;
Telephone number;
Company;
Role;
Customer or lead status;
Preferences;
Goals;
Interests;
Questions;
Needs;
Objections;
Purchase or booking intent;
Timing;
Budget indicators;
Qualification information;
Assessment responses; and
Other information voluntarily provided during an interaction.
Conversation and AI Partner Data
We may collect and process:
Chat transcripts;
AI Partner conversations;
Prompts;
Responses;
Questions;
Conversation timestamps;
Message counts;
Topics discussed;
CTAs surfaced;
Conversation summaries;
Lead-status information;
Intent classifications; and
Other conversational intelligence generated through the Services.
Assessment and Report Information
We may collect:
Assessment answers;
Scores;
Selections;
Qualification criteria;
Personalized outputs;
Generated reports;
Recommendations;
Routing outcomes; and
Related assessment metadata.
Website, Campaign, Attribution, and Behavioral Information
Depending on implementation, EQAI may collect or process:

Landing pages;
Referral information;
Traffic source;
UTM parameters;
Campaign identifiers;
Chat opens;
Chat starts;
CTA clicks;
Assessment starts;
Assessment completions;

EQAI generally does not store full payment-card information where payment information is handled directly by an approved payment processor.

Other communications with EQAI.
3. How We Use Information

Provide the EQAI platform;
Configure and operate AI Partners;
Deliver assessments and reports;
Capture and organize customer intelligence;
Provide lead and conversation context;
Route users to appropriate content, offers, bookings, assessments, or personnel;
Measure website and campaign performance;
Provide attribution and analytics;
Generate audits and recommendations;
Integrate with CRMs, analytics platforms, booking tools, and other systems;
Process payments and manage subscriptions;
Provide onboarding, implementation, support, and managed services;
Communicate with customers and users;
Respond to support requests;
Monitor platform performance;
Detect fraud or abuse;
Maintain security;
Troubleshoot technical issues;
Develop and improve EQAI functionality;
Comply with legal obligations;
Enforce agreements; and
Protect EQAI, our customers, users, and third parties.
4. Customer Data
Customers retain ownership of Customer Data submitted to or collected through the EQAI Services on their behalf.
EQAI processes Customer Data as reasonably necessary to provide, operate, secure, maintain, support, troubleshoot, administer, and improve the Services and fulfill our contractual obligations.
Where EQAI processes personal information on behalf of a customer, that customer may be the data controller, business, or equivalent responsible entity under applicable privacy law, while EQAI may act as a processor or service provider.
The specific legal role depends on the circumstances and applicable law.
5. AI Processing
EQAI uses artificial intelligence, machine learning, large language models, automated workflows, classification technologies, and related systems.
Information processed through EQAI may be transmitted to or processed by AI model providers, infrastructure providers, or other service providers as reasonably necessary to provide the Services.
This may include:
Conversation content;
Prompts;
Knowledge-source content;
Assessment responses;
Customer instructions;
Structured data;
Classification signals; and
Related metadata.
AI-generated outputs may be probabilistic and may contain inaccuracies or other limitations.
Unless expressly authorized otherwise, EQAI does not use identifiable Customer Data to train publicly available or third-party foundation models.
6. Aggregated and De-Identified Information
EQAI may create aggregated, statistical, analytical, or de-identified information derived from use of the Services.
We may use such information for lawful business purposes including:
Product development;
Analytics;
Benchmarking;
Security;
Performance improvement;
Capacity planning;
Research;
Feature development; and
Understanding general platform usage.
We do not intend for such information to reasonably identify an individual or customer.
7. Cookies and Similar Technologies
EQAI and its service providers may use cookies, pixels, local storage, tags, analytics technologies, and similar tools to:
Maintain sessions;
Remember preferences;
Understand website usage;
Measure engagement;
Attribute traffic and campaigns;
Measure conversions;
Improve website performance;
Detect security issues; and
Support analytics.
Customers that deploy EQAI on their own websites are responsible for providing legally required notices and obtaining consent where applicable.
Your browser may allow you to block or delete cookies, although some functionality may not work correctly if certain technologies are disabled.
8. Google Analytics and Google Tag Manager
EQAI may integrate with Google Analytics 4 (“GA4”), Google Tag Manager (“GTM”), and similar analytics technologies.
Depending on the implementation, information such as traffic source, campaign information, chat events, lead events, assessment activity, CTA activity, bookings, purchases, and other journey events may be transmitted to a customer’s own analytics property.
Where a customer uses its own GTM container or GA4 property, the customer is responsible for the configuration and lawful use of those services.
Google’s own privacy terms and policies apply to Google services.
9. How We Share Information
We may disclose information to service providers and other third parties where reasonably necessary to operate EQAI.
These may include:
Cloud-hosting providers;
AI model providers;
Analytics providers;
Payment processors;
Email and communication providers;
CRM providers;
Booking and calendar providers;
Website infrastructure providers;
Customer-support providers;
Security providers;
Automation platforms;
Professional advisers; and
Other technology vendors.
These providers may process information only as permitted by applicable agreements and law.
We may also disclose information:
At the direction of a customer;
With your consent;
To comply with law, regulation, subpoena, court order, or legal process;
To protect rights, safety, property, or security;
To investigate fraud or misuse;
In connection with a merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar corporate transaction; or
Where otherwise permitted by law.
10. We Do Not Sell Personal Information
EQAI does not sell personal information for money.
Depending on applicable law, certain analytics or advertising technologies may be treated as “sharing,” “targeted advertising,” or similar regulated activity even where no money changes hands.
Where required, EQAI will provide legally required choices regarding such activity.
11. Customer Responsibilities
Customers that use EQAI on their own websites, campaigns, or customer journeys are responsible for:
Maintaining their own privacy notices;
Providing required disclosures;
Obtaining consent where required;
Ensuring they have authority to collect and process information;
Configuring tracking technologies lawfully;
Complying with applicable marketing and communications laws; and
Responding to privacy requests relating to information they control.
12. Restricted Information
Unless specifically approved by EQAI in writing and supported by appropriate agreements, users and customers should not submit:
Protected health information regulated by HIPAA;
Full payment-card data;
Passwords or authentication secrets;
Government identification numbers;
Sensitive biometric or genetic information;
Highly sensitive financial-account information;
Information relating to children where special legal requirements apply; or
Other restricted data identified by EQAI.
13. Data Security
EQAI uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information.
These measures may include controls relating to access, infrastructure, authentication, data transmission, monitoring, and service-provider management.
However, no internet-based service, cloud platform, transmission method, or storage system can be guaranteed to be completely secure.
14. Data Retention
We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy.
Retention periods may depend on:
The nature of the information;
The length of the customer relationship;
Contractual obligations;
Operational requirements;
Security requirements;
Legal obligations;
Dispute resolution;

After termination of Services, Customer Data may be retained for a limited period to permit export, backup recovery, legal compliance, security, fraud prevention, or other legitimate business purposes before deletion or anonymization.
Backup copies may persist for additional periods according to standard backup cycles.

16. Requests Relating to EQAI Customers
If your personal information was collected through an EQAI-powered AI Partner or assessment operated on behalf of another business, you should generally direct your privacy request to that business.
EQAI may assist customers in responding to valid requests where required by contract or law.
17. Marketing Communications
You may unsubscribe from promotional EQAI emails using the unsubscribe mechanism included in the communication or by contacting us.
We may continue sending transactional or service-related communications such as:
Account notices;
Billing communications;
Security notices;
Service updates; and
Support communications.
18. International Data Processing
EQAI and our service providers may process information in the United States and other countries.
As a result, personal information may be processed in jurisdictions with data-protection laws different from those where you live.
Where legally required, EQAI will use appropriate mechanisms designed to support lawful international transfers.
19. Children’s Privacy
EQAI Services are intended primarily for business use and are not directed to children.
EQAI does not knowingly seek to collect personal information directly from children in violation of applicable law.
Customers are responsible for determining whether their use of EQAI involves children or minors and for implementing any legally required safeguards or consent processes.
20. Third-Party Websites and Services
EQAI Services may link to, integrate with, or operate alongside third-party websites, platforms, applications, or services.
EQAI does not control the privacy practices of those third parties.
We encourage users to review the applicable privacy policies of third-party services.
21. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our Services, technology, legal obligations, or privacy practices.
When we make changes, we will update the Effective Date.
Where required by law, we may provide additional notice of material changes.
22. California and Other U.S. State Privacy Rights
Residents of certain U.S. states may have additional rights under applicable state privacy laws.
Depending on applicable law and the nature of the processing, these may include rights to:

Where EQAI acts as a service provider or processor on behalf of a customer, requests may need to be submitted directly to that customer.

Where laws such as the GDPR or UK GDPR apply, personal information may be processed based on one or more lawful bases, including:
Performance of a contract;
Legitimate interests;
Consent;
Compliance with legal obligations; or
Other lawful grounds permitted by applicable law.
Where applicable, individuals may have rights including access, correction, deletion, restriction, objection, portability, and withdrawal of consent.
Individuals may also have the right to lodge a complaint with an applicable data-protection authority.
Where EQAI acts as a processor on behalf of a customer, the customer generally determines the lawful basis and purpose for processing.
24. Data Processing Addendum
Where required by applicable privacy law or customer agreement, EQAI may make a Data Processing Addendum available that further addresses:
Controller and processor responsibilities;
Processing instructions;
Confidentiality;
Security measures;
Subprocessors;
International transfers;
Assistance with privacy rights; and
Deletion or return of Customer Data.
