These Billing Terms apply to all EQAI purchases, subscriptions, setup services, trials, installments, renewals, referral discounts, and payment plans unless EQAI states otherwise in writing.
1. Package Fees
Customer agrees to pay the fees shown for the selected package at checkout. Fees may include setup fees, platform license fees, monthly user fees, installment payments, renewal fees, taxes, or usage-based charges.
2. Trial Period
If a package includes a trial period, the trial length and billing start date will be shown at checkout. Unless canceled according to the package terms before the trial ends, Customer authorizes EQAI and its payment processor to charge the payment method on file when the trial ends.
3. Setup Fees
Setup or onboarding fees are due at checkout unless otherwise stated. Setup fees are non-refundable once paid.
4. Platform License Fees
Platform license fees are due according to the selected package. If the package states that a platform license fee is charged after a trial, Customer authorizes EQAI and its payment processor to charge that fee at the end of the trial unless canceled according to the package terms.
5. Monthly User Fees
Monthly user fees are billed according to the selected package. If EQAI covers the first month of a user fee, regular monthly billing begins after the covered period ends.
6. Installments
If Customer selects an installment plan, Customer authorizes EQAI and its payment processor to charge each installment according to the schedule shown at checkout. Installment obligations remain due even if Customer stops using the service before all installments are paid, unless EQAI states otherwise in writing.
7. Renewals
Subscriptions may renew automatically unless canceled or non-renewed according to the selected package terms.
8. Refunds and Cancellations
Unless EQAI states otherwise in writing, fees are non-cancelable and non-refundable once paid. Customer may cancel future renewal or subscription billing according to the cancellation process provided by EQAI, but cancellation does not relieve Customer of amounts already due or committed.
9. Failed Payments
If payment fails, EQAI may retry the payment method, request updated payment information, suspend access, or terminate services after notice and a reasonable opportunity to cure.
10. Taxes
Customer is responsible for applicable taxes, excluding taxes based on EQAI’s net income.
11. Discounts and Referral Pricing
Discounts, referral pricing, beta pricing, or promotional pricing apply only if shown at checkout or confirmed by EQAI in writing. Discounts may apply only to specific fees, packages, terms, or time periods. Unless stated otherwise, discounts do not apply to taxes, overages, or future renewals.
12. Usage and Overage Fees
Some packages may include usage limits. EQAI may measure usage by conversations, sessions, users, assessments, model calls, tokens, interactions, or similar metrics. Usage beyond included limits may be billed according to the applicable package or overage schedule.
13. Payment Processor
Payments are processed through EQAI’s third-party payment processor. Customer agrees to provide accurate payment information and authorizes charges according to the selected package and these Billing Terms.
