Provider: EQ Intelligence AI, Inc. (“EQAI”)
Customer: The business or individual creating an EQAI account and purchasing an EQAI package (“Customer”).
Selected Package
The EQAI package selected by Customer at checkout, including the package name, fees, billing schedule, included services, setup type, trial period if any, and monthly user fee shown on the checkout page.
Services
EQAI provides access to its software-enabled AI Partner platform, including applicable onboarding tools, AI-guided workflows, knowledge-source configuration, assessments, plan/offer routing, reporting, dashboards, support, and related setup services based on the selected package.
License
Subject to payment and compliance with EQAI’s Terms, Customer receives a limited, non-exclusive, non-transferable right to access and use EQAI during the active subscription term for Customer’s internal business purposes and engagement with Customer’s own prospects, customers, guests, or end users.
Fees and Billing
Customer agrees to pay all fees shown at checkout for the selected package. Unless otherwise stated in writing, fees are non-cancelable and non-refundable once paid. If a free or paid trial applies, billing begins according to the package terms displayed at checkout. Customer authorizes EQAI and/or its payment processor to charge the selected payment method for setup fees, platform fees, monthly user fees, installments, renewals, and applicable taxes.
Customer Responsibilities
Customer is responsible for providing accurate business information, website links, brand materials, content, approvals, calendar links, booking links, payment links, and other materials needed to configure and operate EQAI. Customer is responsible for its own website, CRM, booking system, calendar, payment processor, and other third-party systems unless expressly included in the selected package.
AI Output Disclaimer
EQAI uses AI, machine learning, large language models, and automated workflows. AI outputs may contain inaccuracies, omissions, non-unique language, bias, or classification errors. EQAI does not provide legal, medical, tax, accounting, investment, employment, healthcare, or regulated professional advice. Customer is responsible for reviewing AI outputs before relying on, publishing, sending, or acting on them.
Data and Privacy
Customer retains ownership of Customer Data. Customer grants EQAI the limited right to host, process, transmit, display, and use Customer Data as needed to provide, secure, support, and administer the services. Customer agrees not to submit protected health information, sensitive payment card data outside approved processor workflows, or restricted data unless EQAI has approved such use in writing.
Intellectual Property
EQAI retains all rights in its software, platform, prompts, system instructions, workflows, AI Partner structures, assessment logic, report structures, configuration methods, and related know-how. Customer receives only the right to use EQAI during the active term. Customer retains ownership of Customer Data.
No Guaranteed Results
EQAI does not guarantee any specific business result, revenue outcome, lead volume, conversion rate, return on investment, uninterrupted service, complete security, or error-free output.
Limitation of Liability
To the maximum extent permitted by law, EQAI’s total liability related to the services is limited to the amounts paid by Customer to EQAI during the twelve months before the event giving rise to the claim. EQAI is not liable for indirect, incidental, special, consequential, punitive damages, lost profits, lost revenue, lost goodwill, data loss, or business interruption where such limitations are permitted by law.
Term and Cancellation
The subscription term, renewal, cancellation, and non-renewal rules are as shown in the selected package and EQAI Billing Terms. If Customer stops using EQAI before the end of a committed term, all committed fees remain due unless EQAI states otherwise in writing.
Acceptance
By creating an account, selecting a package, checking the required acceptance box, and/or completing checkout, Customer agrees to this Package Acceptance Summary, EQAI’s Terms of Service, Privacy Policy, Billing Terms, and any package-specific terms shown at checkout.
